HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.3465 of 2019 ORDER :
This writ petition is filed seeking Writ of Mandamus declaring the action of respondent No.1 in not permitting the petitioner to teach in JNTUH affiliated Engineering Colleges in CSE/IT Departments in pursuance of the Extraordinary Publication of Gazette Notification dated 06.01.2016 issued by the Government of India, the All India Council for Technical Education (AICTE) notified on 04.01.2016, and for not considering the representations dated 24.08.2018, 12.10.2018, 11.12.2018 and 25.01.2019 submitted by the petitioner, as arbitrary, illegal and in violation of the Articles 14, 19(1)(g) and 21 of the Constitution of India and consequently sought a direction to respondent No.1 to sanction permission to the petitioner to teach in JNTUH affiliated Engineering Colleges in CSE/IT Departments and also by considering representations dated 24.08.2018, 12.10.2018, 11.12.2018 and 25.01.2019 submitted by the petitioner.
The petitioner holds a Doctorate (Ph.D.) in Computer Engineering and has got vast work experience in Teaching field. He is fully qualified and eligible to teach in JNTUH affiliated Engineering Colleges in CSE/IT Departments as per the Extraordinary Publication of Gazette Notification dated 06.01.2016 issued by the Government of India, the All India
Council for Technical Education (AICTE) notified on 04.01.2016. He made several representations dated 24.08.2018, 12.10.2018, 11.12.2018 and 25.01.2019 to respondent No.1 requesting to grant permission to teach in JNTUH affiliated Engineering Colleges in CSE/IT Departments. However, respondent No.1 has not passed any orders on the representations submitted by him. Aggrieved by the same, the petitioner has filed the present writ petition.
Heard Sri C. Vikram Chandra, learned counsel for the petitioner and Sri A. Abhishek Reddy, learned Standing Counsel for respondent No.1 - University.
Learned counsel for petitioner submits that respondent No.1 is not passing any orders on representations submitted by the petitioner nor sanctioned permission to the petitioner to teach in JNTUH affiliated Engineering Colleges in CSE/IT Departments. The learned counsel, therefore, contends that appropriate orders be passed in the writ petition directing respondent No.1 to consider the representations dated 24.08.2018, 12.10.2018, 11.12.2018 and 25.01.2019 submitted by the petitioner and pass appropriate orders in accordance with law.
On the other hand, the learned Standing Counsel for the respondent No.1 - University contends that the case of the petitioner will be considered and appropriate orders would be passed on the representations dated 24.08.2018, 12.10.2018,
11.12.2018 and 25.01.2019 submitted by the petitioner in accordance with law.
This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing respondent No.1 to consider the representations dated 24.08.2018, 12.10.2018, 11.12.2018 and 25.01.2019 submitted by the petitioner seeking to grant permission to teach in JNTUH affiliated Engineering Colleges in CSE/IT Departments by duly taking into consideration the Extraordinary Publication of Gazette Notification dated 06.01.2016 issued by Government of India, the All India Council for Technical Education (AICTE) notified on 04.01.2016, and pass appropriate orders in accordance with law within a period of eight (8) weeks from the date of receipt of a copy of this order. With the above observations, the writ petition is disposed of. No order as to costs.
As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
