HON'BLE SRI JUSTICE R.KANTHA RAO Writ Petition No.31467 of 2015 Order:

Heard Sri Uma Sankar Lokanadham, learned counsel appearing for the petitioner and the learned Government Pleader for Women Development and Child Welfare for the respondents 1 to 4.

2. This writ petition is filed to declare the action of the respondents in not giving appointment order to the post of Anganwadi Worker of Chellapuram village, Merakamudidam Mandal, Vizianagaram district due to pendency of W.P.No.19844 of 2006 filed by Smt. B @ Althi Saraswathi as illegal, arbitrary and in violation of the principles of natural justice and consequently direct the respondents to give appointment orders to the petitioner for the post of Anganwadi Worker of Chellapuram village, Merakamudidam Mandal, Vizianagaram district.

3. It is submitted by the petitioner that she was selected for the post of Anganwadi Worker of Chellapuram village in Merakamudidam Mandal of Vizianagaram district in 2006.

The selection was challenged by one B.Saraswathi by filing W.P.No.19844 of 2006. The grievance of the petitioner is that after selection she also completed the training but on the ground that the said writ petition is pending, the

appointment order was not issued to her though she was selected for the post of Anganwadi Worker. It is further submitted that the said Saraswathi who filed the writ petition in the year 2006 died on 20-7-2011. Inspite of the said fact, it is submitted that the respondents have not issued the appointment order to the petitioner as Anganwadi Worker. The petitioner submitted a representation dated 11-9-2015 to the 4th respondent requesting to issue her, appointment order for the post of Anganwadi Worker but no action has been taken.

4. Under the above circumstances, without going into the merits of the case, the respondents are directed to consider the representation dated 11-9-2015 submitted by the petitioner and pass appropriate orders thereon according to law.

The writ petition is disposed of accordingly at the stage of admission. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
