WRIT PETITION No. 2955 OF 2016 O R D E R :

This is a writ of mandamus filed by the petitioner seeking a direction to the respondent No.4 to register F.I.R. with regard to the theft of pesticide boxes from the lorry bearing No. GJ-6-XX1906 from Sankarda Vadodara district, Gujarat to transport pesticide boxes to Syngenta India Limited, Guntur, Andhra Pradesh.

2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home.

3. The learned counsel for the petitioner submits that the petitioner has lodged a complaint to the Police on 11/12/2015 with regard to the theft of pesticide boxes from his lorry bearing No. GJ-6-XX-1906 but the Police have not registered any crime, and therefore, sought a direction to the Police to register a crime.

4. The learned Assistant Government Pleader submits that the Police have not received any complaint on 11/12/2015 or any other date from the petitioner, and therefore, no action has been taken by the Police.

5. Having regard to the facts and circumstances of the case, the petitioner is given liberty to file a fresh complaint in regard to the incident occurred on 07/12/2015 and the Police may consider

the complaint and take appropriate action in the matter as per law.

6. With the above direction, the writ petition is disposed of.

7. As a sequel, miscellaneous petitions if any, pending in this writ petition stand closed.
