This writ petition, filed under Article 226 of the Constitution of India, challenges the action of the respondents in trying to demolish the structures in Plot No.71 of R.S.No.460/1, situated at Gurunanak Nagar, Vijayawada without passing any final orders in pursuance of the notice issued under Section 452 of the Hyderabad Municipal Corporation Act, 1955 and B.R.S application dated 29.03.2008.

2. Heard Sri T.Balaswamy, learned standing counsel for the Municipal Corporation.

3. When the matter is called today, the learned counsel for the petitioners herein has placed on record the proceedings of the Commissioner of Vijayawada Municipal Corporation vide Rc.G.BPS-5599/2008 dated 07.02.2013 wherein the Municipal Corporation regularized the deviations made by the petitioners herein. The said proceedings further show that all proceedings and action of enforcement initiated or contemplated against the said building are withdrawn. In view of the same, nothing survives for adjudication in the writ petition.

3. For the aforesaid reasons, the writ petition is closed. Pending miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
