ORDER:
This Contempt Case is filed alleging willful disobedience of order, dated 24.12.2014, in Writ Petition No.39012 of 2014.
Respondent No.2 has filed a counter-affidavit and also an additional counter-affidavit.
In his additional counter-affidavit, dated 13.8.2015, respondent No.2 has stated that in pursuance of order, dated 31.7.2015, of this Court, he has accepted a quantity of 53.946 metric tons of Custom Milled Rice delivered by the petitioner from 01.8.2015 to 12.8.2015 as against 79.757 metric tons and that thereby, he is implementing the above-mentioned order of this Court.
Respondent No.2, who is personally present, has assured that he will receive the balance quantity of Custom Milled Rice from the petitioner.
Though respondent No.2 has violated the clear and unequivocal order of this Court by insisting that the petitioner should pay the value of the undelivered rice, upon realising his folly, he has taken remedial steps by accepting the Custom Milled Rice delivered by the petitioner as per the directions issued by this Court. In view of the same, while taking a lenient view, the Contempt Case is closed and the respondents are discharged from the contempt proceedings.
