HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.24554 of 2017 ORDER:
Heard Mr. T. Kistaiah for petitioner and the learned Assistant Government Pleader (Revenue) for respondents 1 to 5.
2. The petitioner prays for the following relief: " ...writ of mandamus declaring that the action of the 4th respondent in trying to dispossess the petitioner from the land and house bearing H.no.6-19/ 1, Block No.6, in part of Sy.No.611/ G consisting of ground floor, RCC roof area situated at Mothkur Village & Mandal, Yadadri-Bhongir District is without due process of law is illegal, arbitrary, without jurisdiction and in violation of principles of natural justice and depriving the fundamental rights guaranteed under Constitution and consequently direct the 4th respondent not to dispossess the petitioner from the land and house bearing H.No.6-19/ 1, Block No.6, in part of Sy.No.611/ G consisting of ground floor, RCC roof area situated at Mothkur Village & Mandal, Yadadri Bhongir District."
3. The Assistant Government Pleader, on instructions submits that Sy.No.611/ G at Mothkur village & Mandal, in an extent of 10 guntas, is patta land and belongs to Smt. Chugani Manjula W/ o Sathyam (petitioner). Sy.No.610 is Government land i.e., Bancharai and is adjoining to Sy.No.611/ G. The respondents are fixing boundaries and demarcating Sy.No.610 and are not interfering with Sy.No.611/ G. The statement is placed on record and accepted. For the purpose of survey and demarcation, it is desirable that the respondents issue notice to petitioner at the time of survey and demarcation with reference to the village site and field maps and thereafter the respondents can protect the Government land and the possession of the petitioner in
Sy.No.611/ G cannot and could not be interfered with except in accordance with law.
4. The writ petition is disposed of accordingly. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
