This petition is filed, under Sections 437 and 439 of the Criminal Procedure Code, 1973, seeking to enlarge the petitioners, who are A2 and A4, on bail in Crime No.10 of 2010 on the file of the Station House Officer, Pakala Police Station, Chittoor District.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.

The counsel for the petitioners submits that A3 in this crime, who stands on the same footing, was enlarged on bail by this court by order, dated 08.12.2017, passed in Crl.P.No.11734 of 2017.

The Public Prosecutor opposes the bail petition on the ground that A1 and A8, who were granted bail, are absconding and are not available for the police, for further investigation and that the case against A3 stands on a different footing, since the case was already split up against A3 and it was committed to the Sessions Court, but the case against these petitioners is still at PRC Stage.

Hence, in view of the above, this court opines that this is not a fit case for granting bail to the petitioners.
With the above observations, the Criminal Petition is dismissed granting liberty to the petitioner to move the bail application after committal. As a sequel, the miscellaneous applications, if any pending, shall stand closed. _ _ _ _ _ _ _ _ _ _ T. RAJANI , J February 16, 2018 LMV
