THE HON'BLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION No.3566 of 2021 ORDER :

Heard learned counsel for the petitioner and learned Government Pleader. With the consent of both sides, this writ petition is disposed of at the stage of admission.

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing respondents 2 and 3 to receive and process the document presented by the petitioner. In the event the said document is found to be fit for registration, respondents 2 and 3 shall complete the due formalities in accordance with law and release the same. However, if they still find any ground to exercise power under Section 71 of the Act of 1908 and refuse registration of the document presented by the petitioner, they shall pass a reasoned order and communicate the same to the petitioner as expeditiously as possible. It is also made clear that mere registration of the said document would not confer any title upon the property covered thereby, if it is otherwise wanting, and would not preclude the Government from taking appropriate steps as warranted by law, if it seeks to assert any right or title over the said land. There shall be no order as to costs. Pending miscellaneous applications, if any, shall stand closed. ________________________ T. AMARNATH GOUD, J.
