HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.29263 of 2015 ORDER:

Heard Sri P.V.V.Satyanarayana, learned counsel appearing for the petitioner, learned Government Pleader for Panchayat Raj & Rural Development, Sri MSR Chandramurthy, learned special counsel for the 3rd respondent and Sri Cheemalapati Ravi, learned standing counsel for the 4th respondent.

2. The petitioner was appointed as field Assistant on 24.05.2007 at Komanapally Village, Mummidivaram Mandal, East Godavari District. On certain charges levelled against him, the petitioner was kept under suspension by calling for his explanation. The petitioner submitted his explanation and after receiving the same, the impugned proceedings dated 04.07.2015 were issued terminating the petitioner from service. Against the termination order, the petitioner filed an appeal to the 2nd respondent, which is now pending.

3. Though it has been contended that the termination order was passed without conducting proper enquiry, since the appeal is pending before the 2nd respondent, this court is not inclined to go into the merits of the case. Therefore, the 2nd respondent is directed to dispose of the appeal preferred by the petitioner and pass final orders thereon, in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order.

4. The writ petition is accordingly disposed of. Miscellaneous petitions, if any, in this writ petition, shall stand closed. No order as to costs.
