HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.4943 OF 2017 ORDER:

The present Criminal Petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short, 'the Code'), requesting to grant regular bail, ofcourse, at the fag end of disposal of S.C.No.427 of 2008 on the file of II Additional Sessions Judge, Hindupur, Anantapur District, Andhra Pradesh State.

2. Heard Sri Chandra Sekhar Reddy, learned counsel for the petitioner - accused, and the learned Additional Public Prosecutor for the State of Andhra Pradesh.

It is the common statement of both sides that the trial has been completed and the last witnesses, who are the Investigating Officers, were examined on 28.06.2017, and the case is now coming up for examination of the petitioner, who is the sole accused involved in an offence of murder, punishable under Section 302 I.P.C. along with Sections 342, 307 and 326 I.P.C., under Section 313 of the Code.

Learned counsel for the petitioner, though, insisted for grant of bail trying to impress upon the Court that the petitioner being a victim of circumstances, had to attack his father, who succumbed to injuries at a later point of time, in connection with his father's refusal to provide finance to him to meet the legal expenses in a matrimonial case between him and his wife pending on the file of this Court, but,

certainly, that cannot be a ground to accede to the relief, at this stage, when, kept in view, the submission made by the learned Additional Public Prosecutor that the petitioner, in fact, evaded his arrest for six years and he could be apprehended only on 24.08.2015, whereas the offence has taken place on 21.12.2007. At this stage, it is, certainly, difficult to enlarge the petitioner on bail and it would be appropriate to direct the II Additional Sessions Judge, Hindupur, to dispose of S.C.No.427 of 2008 within two months from the date of receipt of a copy of this order.

5. Accordingly, the present Criminal Petition is dismissed with a direction to the II Additional Sessions Judge, Hindupur, to dispose of S.C.No.427 of 2008 within two months from the date of receipt of a copy of this order.
