CVNR,J C.R.P.No.5581 of 2016 ORDER:

Feeling frustrated by non-disposal of a partition suit of the year 2011, the plaintiffs have approached this Court under Article 227 of the Constitution of India, for a direction to XI Additional District Judge's Courtcum-Trial Court for Cases under SC & ST Act, Visakhapatnam. 2.

A perusal of the proceeding sheet of the lower Court filed by the petitioners, of whom petitioner Nos.1 and 2 are entering age of 60s, shows that after framing of issues in April, 2013, the suit underwent as many as 34 adjournments from 12.06.2013. I am unable to understand as to why I.As. are not disposed of by the lower Court so far and the trial has not been commenced. The movement of the suit proceedings resembles snail's pace and I am afraid, if the same pattern continues, the petitioners may completely lose faith in the judicial system. 3.

The lower Court, therefore, must sensitize itself to the alarming situation and try to regulate the proceedings before it, by ensuring that the old suits, such as the present one, are disposed of with utmost expedition. The lower Court is, accordingly, directed to fix priorities based on the number of years of pendency and start disposing of the suits strictly serial-wise, while giving preference to the senior citizens' cases. The lower Court is also directed to send its comprehensive report on the details of the pendency of suits before it and the plan of action for their disposal to the Registry of this Court within a period of one month from the date of receipt of a copy of this order. On receipt of such report, the Registry shall place the matter before me on administrative side. 4.

Subject to the above directions, the Civil Revision Petition is disposed of.

As a sequel to disposal of the C.R.P., C.R.P.M.P.No.7234 of 2016 filed by the petitioners for interim relief shall stand disposed of as infructuous.
