The Municipal Employees Colony Development Committee rep. by its President Ch.Anjaiah .. Petitioner and The State of Andhra Pradesh rep. by its Principal Secretary Municipal Administration & Urban Development Department Hyderabad and another .. Respondents Counsel for the petitioner : Mr.B.Chandrasekhar Counsel for respondent No.1: GP for Municipal Administration The Court made the following:
O r d e r :
The grievance of the petitioner, in which this Court sees legitimacy, is that respondent No.2 has turned a blind eye to the encroachments made by some of the residents of Bhimavaram Municipal Employees Colony in a brazen manner.
The photographs filed by the petitioner amply demonstrate this brazenness.
Mr.Nimmagadda Venkateswarlu, learned Standing Counsel for Municipalities (AP), appearing for respondent No.2, submitted that the said respondent has considered the grievance of the petitioner and that its Chairman has initiated the process to convince the residents, who have encroached upon the public road, to remove the encroachments voluntarily and that if such encroachments are not removed, respondent No.2 will initiate action and remove the same within six weeks from today.
In the light of the above submissions of the learned Standing Counsel, the Writ Petition is disposed of with the direction to respondent No.2 to ensure that all the encroachments on the public road/road margin of Bhimavaram Municipal
Employees Colony are removed within the above stipulated time, failing which, this Court will take a serious view of its failure.
As a sequel to disposal of the Writ Petition, WPMP.No.3375 of 2016, filed by the petitioner for interim relief, is disposed of as infructuous. ______________________ (C.V.Nagarjuna Reddy, J) Dt: 29th January, 2016 lur
