HON'BLE SRI JUSTICE SURESH KUMAR KAIT & HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P. No. 2732 of 2018 O R D E R:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) This writ petition is filed assailing the order dated 27.07.2017 in O.A.No. 3117 of 2014 passed by the A.P. Administrative Tribunal, Hyderabad whereby the application filed by the petitioner under Section 19 of the Administrative Tribunals Act, 1985 seeking to set aside the proceedings dated 24.03.2014 issued by the 3rd respondent imposing penalty of stoppage of one increment without cumulative effect, was dismissed.

It is not in dispute that the order imposing penalty of stoppage of one increment without cumulative effect was passed in March, 2014. The O.A. was filed by the petitioner during the currency of the penalty, and now, we have entered into the year 2018, as such, the period of penalty was over by the end of 2015. In addition to the above, the petitioner has not filed any appeal before the competent authority by invoking Rule 33 of the Andhra Pradesh Civil Services (Classification, Control and Appeal) Rules, 1991. Hence, we find no merit in the writ petition and the same is accordingly dismissed. However, the petitioner, if so advised, may file an appeal before the appellate authority

SKK,J & AKS,J WP_2732_2018 against the order dated 27.07.2017 passed by the Tribunal. No order as to costs.

As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
