The present Writ Petition, under Article 226 of the Constitution of India, is filed to declare the action of the respondents in not properly examining the petitioner's fitness by the Medical Board and declaring him as fit, as illegal and arbitrary and consequently to direct the respondents to assess the petitioner's fitness as directed by this Court in W.P.No.38451 of 2015 and Batch. 2.

When the matter is taken up for hearing, learned counsel for appearing for both sides submits that the issue involved in this writ petition is covered by the order dated 22.06.2016 passed by this Court in W.P.No.38451 of 2015 and Batch.

Following the above said order and for the reasons recorded therein, the Writ Petition is also disposed of, in terms thereof. Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
