THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.929 OF 2018 ORDER:

This petition is filed by the petitioner-appellant under Section 483 Cr.P.C. seeking a direction to the Principal Sessions Judge, Kadapa, to dispose of Crl. Appeal No.179 of 2017 within two months without insisting the presence of the petitioner-appellant.

Heard learned counsel for the petitioner, learned Assistant Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioner would submit that the subject matter relates to DVC. Further, the petitioner-appellant is working in USA.

There is no statutory provision making the appearance of the petitioner-appellant compulsory in an appeal preferred against DVC case. Therefore, the Sessions Court shall not insist the appearance of the petitionerappellant in Crl.A.No.179 of 2017. Further, it is the right of the petitioner-appellant to get early disposal of the criminal proceedings. Under these circumstances, the learned Principal Sessions Judge, Kadapa, shall dispose of Crl.A.No.179 of 2017 within three (3) months from the date of receipt of copy of this order.

Accordingly, the Criminal Petition is disposed of. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
