THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY WRIT PETITION No.21512 OF 2016 ORDER:

1 This Writ Petition is filed under Article 226 of the Constitution of India seeking writ of mandamus to declare the seizure of Red Grad Dall 377.50 Qtls, Raw Bengal Gram Dail 431.Qt1s., Black Gram without husk 201.50 Qtls. Green Gram Dall 103.50 Qtls total worth of Rs.1,05,86,500/- of the petitioner, by conducting panchanama dated 23.6.2016 is illegal, arbitrary, improper and without any power or authority.

2 At the time of arguments, the learned Assistant Government Pleader, on instructions, submitted that the petitioner submitted an application to the second respondent on 27.06.2016 for release of the stock seized by the third respondent.

3 The learned counsel for the petitioner submitted that the second respondent may be directed to dispose of the application dated 27.06.2016 made by the petitioner.

4 The third respondent seized huge stock of the petitioner. If no orders are passed, the same may cause prejudice to the petitioner. 5 Taking into consideration the facts and circumstances of the case, the second respondent is hereby directed to dispose of the representation dated 27.06.2016 made by the petitioner for release of the stocks within two weeks from the date of receipt of a copy of this order.

6 With the above direction, this Writ Petition is disposed of. No order as to costs. As a sequel, miscellaneous petitions if any pending in this writ petition shall stand closed.
