HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.3146 of 2019 ORDER:

This writ petition is filed seeking the following relief :- " .....to issue a Writ, Order or Direction one in the nature of Writ of Mandamus declaring the action of the respondents 1 to 5 in not paying monthly salary as illegal violative of Fundamental rights guaranteed under Articles 14 and 21 of the Constitution of India and consequently direct the respondents to continue to pay the salary to the petitioner regularly including the arrears of salary since onwards......" .

Heard Smt.P.Vijaya Lakshmi, learned counsel for petitioner and the learned Standing Counsel for respondents. It has been contended by the petitioner that she was appointed as Seniormate during the year 2017. The grievance of the petitioner is that though she has discharged her duties without any complaint, the respondents have not paid salary to the petitioner.

Learned counsel for petitioner submits that appropriate orders be passed in the writ petition directing the respondents to pay salary to the petitioner on month to month basis. On instructions, learned Standing Counsel appearing for respondents has contended that the petitioner has worked upto 01.11.2018 and thereafter, she has not worked with the respondents. The respondents would pay salary to the petitioner upto to 01.11.2018.

This Court, having considered the rival submissions, is of the considered view that this writ petition can be disposed of directing the respondents to pay salary to the petitioner upto 01.11.2018

within a period of two weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
