O R D E R

This Criminal Petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused No.1 seeking enlargement on bail in connection with Crime No.914 of 2025 of KPHB Colony Police Station, Cyberabad Commissionerate. The offences alleged against the petitioner are under Sections 105, 126(2), 352 read with 3(5) of BNS.

The case of the prosecution is that, on 16-07-2025, while defacto complainant was patrolling at about 2:00 A.M., he received information that an unknown person was found unconscious near D-Mart at V-Phase, KPHB Colony, with an injury to his face. Upon enquiry, the person was identified as Suryakanth. He further stated that three individuals had quarreled. While they were walking along the road, two unknown persons stopped them, questioned where they were going, abused them in filthy language, assaulted them with their hands, and beat the injured with a stick. Based on this report, the police registered a case in Crime No.914/2025 initially for the offences punishable under Sections 118(1), 126(2), and 352 read with Section 3(5) of the BNS. During the investigation, upon receipt of death intimation, the police altered the sections of law to 105, 126(2), and 352 read with Section 3(5) of the BNS.

Heard Sri A. Prabhakar Rao, learned counsel for the petitioner and Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of the learned counsel for the petitioner is that the petitioner is innocent of the allegations and that there is no acquaintance between the petitioner and the deceased. He further submitted that the petitioner has been in judicial custody

- 3 - since 26.11.2025 and that the crucial part of the investigation has already been completed. Hence, he prayed the Court to grant bail to the petitioner.

On the other hand, the learned Additional Public Prosecutor vehemently opposed the submissions made by learned counsel for the petitioner, contending that the allegations against the petitioner were grave and heinous in nature. He further submitted that the investigation is ongoing and therefore, he prayed the Court to dismiss the criminal petition.

In light of the submissions made by both learned counsel and upon perusal of the material available on record, it is evident that the petitioner has remained in judicial custody since 26.11.2025 and that there is no prior acquaintance or dispute between the parties. As seen from the remand report, prosecution witnesses LWs.1 to 16 have already been examined, and except for the filing of the charge sheet, the entire investigation has been completed. Considering the overall facts and circumstances of the case, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitionerAccused No.1, subject to the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees

- 4 - Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned III Additional District and Sessions Judge, MedchalMalkajgiri District at Kukatpally. ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.

(presently, Section 480(3) of the BNSS).
