THE HONOURABLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.914 of 2019 ORDER :
The petitioners are accused Nos.3 and 5, among five or more accused in Crime No.583 of 2018 of the Station House Officer, Jubilee Hills Police Station, Hyderabad, registered for the offences punishable under Sections 302, 498-A read with Section 109 IPC and Sections 3, 4 and 6 of Dowry Prohibition Act, dated 16.09.2018, from the father of the deceased.
A1 is the husband of the deceased, A2 is the father-in-law of the deceased, A3 is the mother-in-law of the deceased, A4 is the brother-in-law of the deceased and A5 is the sister-in-law of the deceased.
As per the remand report dated 24.09.2018, A2 to A5 are shown as absconding and A1 was arrested on 23.09.2018 and from perusal of the same running in nine pages, as pointed out by the learned Public Prosecutor and from page Nos.3 to 7 in particular, there are allegations against the petitioners also from their continuous demand and harassment of the deceased to sell the house of 120 square yards at Hafeezpet, in the name of the deceased, to get the amount by accused and there is abetment by other accused, including from registration of crime, for the offence punishable under Section 109 IPC, even the deceased was shown brutally murdered at the house of the parents of the deceased by A1. The fact that subsequently A2 and A4 surrendered and was granted regular bail from judicial custody
on 20.11.2018 in Crl.M.P.No.3752 of 2018, dated 06.11.2018, also by considering the fact of A1 was granted on the self same day by self same Court in Crl.M.P.No.3690 of 2018 from judicial custody since 20.11.2018 regular bail, not a ground to give any concession to the petitioners for anticipatory bail, but for left open, if at all to surrender and move for regular bail.
Accordingly, the Criminal Petition is dismissed. Needless to say from any change in circumstances, it is not a bar to move either fresh regular bail or anticipatory bail, as the case may be, to consider on merits.
