This contempt case is filed alleging wilful disobedience of order dt.13.11.2015, in W.P. No.36918 of 2015.
A perusal of the pleadings of the petitioner and the material filed in support of the same shows that before filing this contempt case no written notice has been issued to the respondent. As contempt proceedings are quasi criminal in nature, unless the aggrieved party issues notice to the person who allegedly indulged in violation of the Judicial Order, he is not entitled to invoke the contempt jurisdiction of this Court. In view of the same, this contempt case is dismissed, however, with liberty to the petitioner to issue a notice in writing to the respondent to refrain from interfering with her possession of the land and avail a fresh remedy, in the event the respondent continues to interfere with her possession.
