The petitioners' state that they made an application on 1809-2015 for succession with regard to the subject lands on the basis of the report given by the 4th respondent under Ex.P-6, dated 11-08-2015 to the State Information Commissioner. The petitioners also made further application on 25-03-2015 requesting to grant succession in respect of the lands in question. But, after due enquiry, the same was stated to have been rejected on 08-05-2015. A copy of the said rejection order is also filed as Ex.P-7. The present writ petition is, however, filed questioning inaction of the 4th respondent in granting mutation.
Heard the learned Government Pleader for Revenue. It is evident from Exs.P-6 and P-7, referred to above, that in respect of some of the lands, succession was stated to have been granted in favour of the petitioners as noted in Ex.P-6. Hence, if there is any application pending by the petitioners seeking mutation with regard to the lands not covered by the said succession order, the 4th respondent has to consider the same and pass appropriate orders. However, to the extent of the order of the 4th respondent rejecting the request for mutation of other lands, as noted above, if the petitioners are aggrieved, it is for them to take appropriate further measures. Hence, let the 4th respondent to act accordingly to the extent of the lands in respect of which, succession was not granted by him, if any application of the petitioners for mutation is pending and pass appropriate orders in accordance with law.
Accordingly, the writ petition is disposed of. No costs Miscellaneous petitions, if any, pending shall stand closed.
