The case of the petitioner is that his father was appointed as Driver in the respondent‐Corporation in the year 1993 and after discharging his duties as such for a considerable period, he suffered ill‐health and was declared unfit to discharge the duties of a Driver. For some period he was engaged as Shramik, but he could not perform that duty as well and was made to retire from service on 19‐12‐2015, but shortly thereafter he left to heavenly abode. 2.

The grievance of the petitioner is that his father had five years of left over service and was made to retire on medical grounds, as per the scheme of compassionate appointments, his candidature is liable to be considered for compassionate appointment to any suitable post in the respondent‐Corporation and in that behalf the petitioner made representation dated 02‐05‐2017, but to no avail. Hence, this writ petition.

Heard the learned counsel for the petitioner and the learned Standing Counsel for the respondent‐Corporation.

It is to be seen that the respondent‐Corporation has evolved a scheme to provide employment to the spouse/child of medically unfit employees instead of providing alternative employment to the employees themselves, vide Circular No.PD/19/2015, dated 03‐06‐2015. Going by the terms of the said circular, the petitioner is entitled to seek for consideration of his candidature for compassionate appointment. In the circumstances and to meet the ends of justice, the respondent‐authorities are directed to consider the case of the

petitioner for compassionate appointment to any suitable post in accordance with the scheme framed in the above said circular and in according with the Rules governing the field and pass appropriate orders thereon, in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. 5.

With the above directions, the writ petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any pending in this case shall also stand disposed of.
