HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35414 of 2016 ORDER:

This writ petition is filed by the petitioners under Article 226 of the Constitution of India seeking to quash the proceedings against them in Crime No.45 of 2016 on the file of Nindra Police Station, Chittoor District. 2.

Heard and perused the material available on record. 3.

It is stated in the affidavit that there are disputes with regard to factory between one Chadalawada Krishna Murty and the management of the factory. Originally, the Company obtained interim injunction order against Chadalawada Krishna Murty and others. On 25.8.2016, when the petitioners showed the injunction orders, the followers of the said Krishna Murty including the 3rd respondent created nuisance and threatened the staff. Immediately, the 1st petitioner made a report to the 2nd respondent and on the basis of the said report a crime was registered against the said Krishna Murty and others and as a counter-blast to the said case, the present complaint was lodged against the petitioners by the 3rd respondent, who is working under Chadalawada Krishna Murty. 4.

The petitioners filed this writ petition challenging the investigation in the above crime. This Court is not inclined to interfere with the investigation. However, taking into consideration the facts and circumstances of the case and the case and counter cases, this Court is of the view that the investigation can be completed without arresting the petitioners.

Accordingly, respondents Nos.1 and 2 are directed to complete the investigation and file a final report in the above Crime, in accordance with law in either way, without arresting the petitioners. 6.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
