Subba Rao Petitioner (Accused No.5 in Cr.No.604/2017 of Ibrahimpatnam P.S., Vijayawada City) AND The State of Andhra Pradesh, rep by its Public Prosecutor, High Court of Judicature of Hyderabad, for the State of Telangana and the State of Andhra Pradesh. Respondent Petition under Sections 437 & 439 of Cr.P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to pass orders enlarging the Petitioner/Accused No.5 on bail pending enquiry and trial in crime No. 604 of 2017 of Ibrahimpatnam Police Station, Vijayawada City. The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri Prabhakar Sripada, Advocate for the Petitioner and of the Public Prosecutor (AP) for the Respondent, the Court made the following ORDER:

" This petition is filed, under Sections 437 and 439 of the Criminal Procedure Code, 1973, seeking to enlarge the petitioner, who is A5, on bail in Crime No.604 of 2017 on the file of the Station House Officer, Ibrahimpatnam Police Station, Hyderabad.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The counsel for the petitioner submits that A1 in the present crime was already granted bail, by virtue of the order, dated 19.01.2018, passed by this Court in Crl.P.No.24554 of 2017 and that this petitioner also stands on the same footing. The same is not refuted by the Public Prosecutor. 4.

Hence, in terms of the order of this court in Crl.P.No.24554 of 2017, dated 19.01.2018, the Criminal Petition is allowed and the petitioner is directed to be enlarged on bail on condition of his executing a personal bond for a sum of Rs.40,000/- (Rupees forty thousand only) with two sureties for a like sum each to the satisfaction of the Metropolitan Sessions Judge, Vijayawada, and to appear before the trial Court on the dates given by the concerned Court. As a sequel, the miscellaneous applications, if any pending, shall stand closed."
