This writ petition is filed challenging the proceedings vide Roc.6100/2009-A1 dated 12.10.2011 issued by the 2nd respondentMunicipality asking the petitioner to surrender the shop stating that there is no scope for renewal as lease period granted to him has exceeded 25 years.
The case of the petitioner is that he has received an endorsement dated 03.01.2011 vide Roc.No.6100/2009-A issued by the Commissioner, 2nd respondent-Municipality intimating that the petitioner's lease period cannot be extended, as 25 years have been completed from the date of original lease and that he should surrender the shop on completion of the existing lease. Against the same, petitioner made several representations to the 2nd respondent requesting for extension of lease at the enhanced rent. But the 2nd respondent without considering the same directed the petitioner to vacate the premises. Aggrieved by the same, the present writ petition is filed.
Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for the 1st respondent submits that the respondents have no power to grant lease beyond 25 years in view of the orders passed by the Division Bench of this Court in W.P.No.6354 of 2009 dated 25.08.2009. He further submits that following the said order, this Court has disposed of W.P.No.30741 of 2011 and batch and W.P.No.8217 of 2015.
In view of the above, this writ petition is disposed of in terms of orders passed in W.P.No.30741 of 2011 and batch and W.P.No.8217 of 2015. There shall be no order as to costs. As a sequel, miscellaneous petitions pending if any, shall stand closed. Let a copy of the order in W.P.No.30741 of 2011 and batch and in W.P.No.8217 of 2015 be annexed to this writ petition.
