THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.8157 OF 2015 ORDER:
Heard the learned counsel appearing for the petitioner. There is no representation on behalf of respondents. The prayer sought for in the writ petition is as under: " to issue an order direction or writ more particularly one in the nature of Writ of Mandamus declaring the action of the (a) 1st respondent herein in not including the agriculture gold loan account No. AGL. 700430049011524 of 3rd respondent bank in the list of loan waiver scheme as arbitrary, illegal, null and void and against the principles of natural justice and in violative of G.O.Ms. No. 174, dated 14.08.2014 G.O.Ms. No. 181, dated 01-09-2014 (b) 3rd respondent herein in issuing Public Auction Notice of Gold Ornaments dated 11-03-2015 of 3rd respondent Branch in respect of A/ c. No. AGL.
700430049011524 as arbitrary, illegal, null and void and against the principles of natural justice and to set aside the same; and Consequently to direct the 3rd respondent to release the gold ornaments pledged by the father of the petitioner in the A/ c. No. AGL. 700430049011524 of 3rd respondent bank in favour of the petitioner and to pass such other order or orders as this Hon'ble court deem fit and proper in the interest of justice."
During the course of hearing, the learned counsel brought to the notice of this Court that the 2nd respondent-Bank has included the agricultural gold loan account of the petitioner in the list of loan waivers scheme as per the orders passed in G.Os.No.174, dated 14.08.2014 and G.O.Ms.No.181, dated 01.09.2014. The learned counsel also brought to the notice of this Court that after inclusion, the Government have also paid two instalments as per the orders in the above G.Os.
In that view of the matter, this Court is of the opinion that no cause would survive in the writ petition and accordingly, the Writ Petition is closed. No costs.
