ORAL ORDER:

Petitioner is placed under suspension on the allegation that she was unauthorisedly absent without sanction of the competent authority and without prior permission during the peak Khariff season and was also not available on the mobile phone. When the matter is taken up, learned Government Pleader raised objection on maintainability of the writ petition contending that Rule 32 of the APCS (CCA) Rules provides appeal against the orders of suspension and without availing the said remedy, writ petition is filed. Learned counsel for petitioner does not dispute that petitioner has remedy of appeal against the order passed by the competent authority. Having regard to the fact that remedy of appeal is available to the petitioner, this Court is not inclined to entertain writ petition at this stage.

Granting liberty to the petitioner to avail the remedy of appeal, writ petition is dismissed. However, as and when such an appeal is filed, the authority shall consider the same and pass appropriate orders in the said appeal as expeditiously as possible, preferably within six weeks from the date of receipt of appeal. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed.
