THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE T.AMARNATH GOUD WRI T PETI TI ON NO.2687 of 2018 ORDER: (per SK,J) The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a writ, order or direction, particularly one in the nature of Writ of Mandamus, declaring the sale of auction conducted by the 3rd respondent on 15.12.2017 pursuant to the sale notice dated 8.11.2017 published in Sakshi Telugu Daily News Paper on 12.11.2017 in respect of the property i.e. land in Sy.No.157 to an extent of Ac.7.29gts situated at Chikatimamidi village, Bommalaramaram Mandal, Kanchal Thanda Grampanchayat, Nalgonda District, as illegal and arbitrary and consequently set aside the aforesaid sale auction held on 15.12.2017 and to pass such other order or orders mayl deem fit and proper in the circumstances of the case.'

Smt.T.Vidya Rani, learned counsel for the Bank of India, the first respondent, states on instructions that the auction sale held on 15.12.2017 was cancelled and the sale certificate issued to the successful bidder in the said auction sale was also cancelled subsequently. In effect, challenge to the said auction sale does not deserve consideration on merits owing to the aforestated development.

Recording the statement of Smt.T.Vidya Rani, learned counsel, the writ petition is closed.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
