THE HONOURABLE DR.JUSTICE G. RADHA RANI CRIMINAL PETITION No.1481 of 2024 O R D E R:

This Criminal Petition is filed by the petitioner - accused under Section 437 and 439 of Code of Criminal Procedure (for short "Cr.P.C.") for grant of bail in Crime No.14 of 2024 of Nacharam Police Station, Rachakonda, registered for the offences under Section 8(c) read with 20(b)(ii)(B) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short "NDPS Act"). 2.

The case of the prosecution in brief was that on 05.01.2024 at 05:00 PM, the Sub-Inspector (for short "SI") of Police of PS Nacharam, while conducting vehicle checking found a person proceeding on an Activa Vehicle, apprehended him, on enquiry, the SI of Police came to know that he was transporting ganja in the dickey of his motorcycle. The SI of PS Nacharam secured the Gazetted Officer, the Detective Inspector of Uppal Police Station and in his presence, conducted panchanama and seized the contraband dry ganja of 1.2 kgs from the possession of the accused in the presence of the panch witnesses. 3.

Basing on the said report, the Crime No.14 of 2024 was registered by the Nacharam Police under Section 8(c) read with 20(b)(ii)(B) of NDPS Act.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the State.

Learned counsel for the petitioner submitted that there were no criminal antecedents against the petitioner and he was in custody since 05.01.2024 and only an intermediary quantity of 1.2 kgs of dry ganja was recovered from his possession.

Learned Additional Public Prosecutor for the State also reported that there were no criminal antecedents against the petitioner. 7.

Considering the submissions of both the learned Counsel, as only 1.2 kgs of dry ganja was seized from the possession of the petitioner and no criminal antecedents are reported against him, it is considered fit to enlarge the petitioner on bail.

In the result, the Criminal Petition is allowed directing the petitioner to be released on bail on his executing a personal bond for Rs.15,000/- with two sureties for the like sum each to the satisfaction of the I Additional Junior Civil Judge - cum - V Additional Metropolitan Magistrate, Medchal-Malkajgiri District and the petitioner shall comply with the conditions as laid down under Section 437 (3) of Cr.P.C.
