THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.1026 OF 2019 ORDER:

Heard learned counsel for the petitioner and also the learned Public Prosecutor representing the 1st respondent State before admission and before notice to the 2nd respondent. 2.

It is not even a case that charges framed. Even the material is insufficient before the Court to go into the merits as on date and liberty is always available to the petitioner being A-4 along with others are independently to file application for discharge, if no grounds to permit charge for the trial Court to consider.

Subject to that, the Criminal Petition is disposed of before admission by giving liberty under Rule 37 of the Criminal Rules of Practice to represent through other accused and in the event of filing any such application, the learned Sessions Judge shall consider after hearing with conditions of personal appearance as and when required. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
