SMT JUSTI CE T. RAJANI CRI MI NAL PETI TI ON No.8 6 2 5 of 2 0 1 7 & I A.Nos.1 an d 2 of 2 0 1 8 ORDER:

I A.Nos.1 an d 2 of 2 0 1 8 :

The applications are filed seeking permission to compound the offences and to record the compromise entered into by the parties and quash the proceedings against the petitioner in C.C.No.61 of 2016 on the file of the Additional Judicial First Class Magistrate, Vizianagaram. 2.

The parties, together, with their respective counsel, are present in the Court and on being specifically asked, both the parties confirm the terms of compromise as recorded in the joint memo appended to the application in IA.No.2 of 2018 and the settlement entered into buy the parties before the Lok Adalat by virtue of award in Lok Adalat Case No.1319 of 2018 dated 08.09.2018.

3.

The terms of the compromise show that the petitioner has compromised for reunion by entering into terms of compromise memo filed before the Lok Adalat at Vizianagaram; that the petitioner and the second respondent are living together along with minor daughter and that the second respondent has no objection for quashing of the proceedings in CC.No.61 of 2016 on the file of the Additional Judicial First Class Magistrate, Vizianagaram. Since, I am satisfied that the aforesaid compromise is executed by the parties out of their free will and they confirm the terms thereof, when being specifically asked, there is no impediment in recording the said compromise. The applications are accordingly allowed.

CRLP.No.8 6 2 5 of 2 0 1 7 :

In view of the above, the criminal petition is allowed and the proceedings in C.C.No.61 of 2016 on the file of the Additional Judicial First Class Magistrate, Vizianagaram, against the petitioner, are hereby quashed. As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
