Heard learned counsel for the petitioners as well as learned Assistant Government Pleaders for Land Acquisition and Irrigation.

The petitioners seek a direction to the respondents to pay the compensation amount in respect of their respective land in an extent of Acs.3.26 guntas in Survey No. 72/ 2 and Acs.9.09 guntas in Survey No. 55/ 2 situated at Panagal Village, Nalgonda Mandal and District, which was acquired for excavation of canal system for Udayasamudram Lift Irrigation Scheme of AMRSLBC Project as per Notification, dated 21.02.2018. The apprehension of the petitioners is that the respondents may award the compensation at lower rate as against their claim for the market value at Rs.50 lacs per acre.

There is no dispute at this point of time that the land acquisition proceedings in terms of the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 have already been invoked, declaration under Section 19 of the Act has been issued, however, no enquiry has been conducted nor award has been passed.

Award under Section 23, and take into consideration the claim / objections of the petitioners apart from the material that may be placed by them in support of the claim that their land would fetch the market value at Rs.50 lacs per acre. It is also made clear that it is the duty of the Land Acquisition Officer to deal with the objections / claim of the petitioners in accordance with law. No costs.
