HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY Writ Petition No. 16856 of 2012 ORDER :

This writ petition is filed seeking writ of mandamus directing the respondents 1 to 6 to protect the public water tank situated in Ac.7.88 cents in Sy.No.272/16, Nallamadu Revenue Village, Vunguturu Mandal, West Godavari District for public purpose, without allowing any encroachment by respondents 7 to 11 and preventing registration of any documents connected to the said tank and without issuing pattadar passbook and title deeds in favour of anybody including respondents 7 to 11 by initiating necessary action on the representation dated 25.05.2012 submitted by petitioners.

Counter affidavit is filed by the respondents 1 to 3 stating that the villagers of Nallamadu of Unguturu Mandal gave representation and requested not to issue pattadar passbooks to the respondents 7 to 11 and also requested to protect the public water tank situated in R.S.No.272/16 for an extent of Acs.7.88 cents. It is stated that after enquiry by the revenue officials, it is found that the subject land in R.S.No.272/16 admeasuring Acs.7.88 cents is vacant and not a public water tank as contended by the petitioners. It is stated that the 5th respondent had issued Certificate dated 12.12.

2010 stating that this land is 'Chinthala Cheruvu' but subsequently, the 7th respondent had filed an application before the Revenue Divisional Officer, stating that by mistake the subject land is shown as Cheruvu and further requested the 2nd respondent to delete the subject land from the classification of 'Cheruvu'. The 2nd respondent after obtaining report from the Tahsildar and basing on the entries in the Revenue Records, directed the 5th respondent to delete the subject land as Cheruvu and further stated that the subject land i.e., Sy.No.272/16 an extent of Acs.7.88 cents is an Inam land. Therefore, vide proceedings No.No.1743/2010(D), dated 30.07.2010 declared as Inam Punja, as such, the allegation of the petitioners that the above land is 'Cheruvu' is not correct. It is stated that the representation of the petitioners dated 20.05.

Revenue Authorities and an endorsement was issued on 09.07.2012 stating that the above land is an Inam Punja.

Heard Sri Nimmagadda Satyanarayana, learned counsel for the petitioners, learned Government Pleader for Revenue appearing for respondents 1 to 3 & 5, Sri Ravi Cheemalapati, learned Standing Counsel for the 6th respondent and Sri K.Sai Krishna Mohan Rao, learned counsel for the respondents 7 to 9.

Since it is stated in the counter affidavit of the respondents 1 to 3 that the representation of the petitioners had been considered and disposed of, no further orders are required to be passed in this writ petition. Accordingly, this Writ Petition is closed. There shall be no order as to costs. As a sequel thereto, miscellaneous applications, if any pending in this Writ Petition, shall stand dismissed.
