HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No. 3184 of 2020 ORDER:

This writ petition is filed challenging the action of the respondents in laying radial road No.7 from Tellapur junction to Edugulanagulapally through the subject lands of the petitioners, without notice and without following the procedure established under law. Learned counsel for petitioners submits that in spite of the orders passed by this Court in IA.No.1 of 2018 in WP.No.18283 of 2018, dt.04.06.2018 and in spite of quashing notification issued under Section 11(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, in WP.No.12007 of 2019 filed by the petitioners, the respondents are trying to dispossess the petitioners without initiating fresh land acquisition proceedings.

On the other hand learned Assistant Government Pleader for Roads and Buildings and learned Assistant Government Pleader for Land Acquisition, basing on written instructions submits that in pursuance to the orders passed in the aforesaid writ petitions they are not dispossessing the petitioners from the subject lands, and that they have not taken up any activity in the petitioners' land on 5.02.2020. In view of the aforesaid submission, recording the same, the writ petition is disposed of directing the respondents not to dispossess the petitioners from the subject lands without further initiating fresh land acquisition proceedings.

As a sequel to the disposal of this petition, interlocutory applications, if any, pending shall stand closed. No order as to costs. __________________________ A.RAJASHEKER REDDY, J 14.02.2020 Note:
