THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.7997 OF 2017 ORDER:

Heard learned counsel for the petitioners/A1 to A3 of C.C.No.989 of 2016, pending on the file of Judicial First Class Magistrate, Suryapet, taken cognizance for the offences punishable under sections 420, 468, 471 r/w 34 IPC and also heard the learned public prosecutor, representing the respondent - State, including for the defacto complainant - Tahsildar.

Perused the grounds urged in the quash petition and earlier discharge application filed pending investigation was dismissed as it was premature.

Having regard to the above and from no Part II CD even filed to go into the merits, this criminal petition is disposed of, giving liberty to file a fresh discharge application, under section 239 Cr.P.C., since the final report filed by the police was taken cognizance by the learned Magistrate, where the entire material available to pass orders thereon after hearing at any cost within two months from the date of receipt of a copy of this order. Further remedies aggrieved if any left open.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
