The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit, it is therefore prayed that this Hon'ble Court may be pleased to issue writ or order or directions especially one in the nature of writ of Mandamus declaring the action of Respondents that, the respondents are intentionally not inserting the petitioners survey numbers 301/B admeasuring Ac 8-04 Gts, 304/B admeasuring Ac 1-15 Gts, 306/B admeasuring Ac 5-28 Gts, 307/B admeasuring Ac 1-21 Gts, 309/B admeasuring Ac 1-06 Gts, 310/B admeasuring Ac 0-21Gts, total extent of Ac 019-34 in the new patta pass book of petitioner and not disposing the representation pertaining to inclusion of above survey numbers dated 22.5.
2018 is illegal, arbitrary, grave mistake and violate the Article 14 of constitution of India and besides being opposed to the principles of natural justice and direct the respondent No.3 to dispose the representation pertaining to inclusion of above survey numbers dated 22.5.2018 and pass such order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.' Perusal of the record reflects that the petitioner was issued regular pattadar pass books under the provisions of the Telangana Rights in Land and Pattadar Pass Books Act, 1971. As some of the survey numbers were not included in the new patadar pass books, the petitioner made representation dated 22.05.2018 to the Tahsildar, Cherial Mandal, Siddipet District, requesting him to do the needful.
Complaining of inaction on the part of the said authority, he is before this Court. The aforestated representation demonstrates that the office of the Tahsildar affixed a stamp thereon in evidence of its receipt on 22.02.2018 itself. In that view of the matter, it is not open to the Tahsildar, Cherial Mandal, to remain inactive upon the petitioner's representation.
The writ petition is accordingly disposed of directing the Tahsildar, Cherial Mandal, Siddipet District, to take appropriate action on the petitioner's representation dated 22.05.2018 expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.
