THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.14183 OF 2017 ORDER:

This writ petition is filed challenging the tender notification, dated 05.04.2017, calling for the tenders in Mahaboobnagar District, for procuring eggs of Anganwadi of ICDS projects for the year 2016-17, contrary to the work order given to the petitioner on 25.03.2017. The learned Government Pleader, on the basis of the written instructions, submits that previously tender was called but the same was cancelled on the basis of the adverse report of CDPO, dated 03.02.2017. A fresh tender was called on 02.03.2017 and the same was also cancelled due to forming of alliance among the bidders and quoting high bid by one single participant. A re-tender was called on 16.03.2017 and proceedings was issued on 25.03.2017 to the qualified farmers. However, on 04.04.

2017, a poultry farmer, whose tender was cancelled on the basis of the report of the CDPO on 03.02.2017, submitted a representation to the District Collector, Mahabubnagar, requesting to give another opportunity by calling a re-tender. So the re-tender, dated 16.03.2017 was cancelled on 05.04.2017 and a fresh tender was called on 05.04.2017. The technical bids were opened on 11.04.2017 and price bids are not yet opened. The learned counsel for the petitioner submits that that the petitioner participated in the said tender process and if that is so, it is open to the respondents to take further steps pursuant to the tender notice, dated 05.04.2017.
