HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.3224 of 2019 ORDER :

This writ petition is filed seeking Writ of Mandamus declaring the action of the respondents in not disposing of the representations dated 12.07.2017 and 28.12.2018 submitted by the petitioner and not considering his case for re-engagement in the post of Conductor inspite of the repeated requests made by him, as arbitrary and illegal and consequently sought a direction to the 2nd respondent to continue the petitioner as a Conductor by re-engaging his services or alternatively to appoint him as a fresh Conductor.

The petitioner was initially appointed as a Conductor on contract basis in September, 2010 and while discharging his duties as Conductor, the respondents have dis-engaged the services of the petitioner as Conductor in 2011 without assigning any reasons. Thereafter, the petitioner has been making series of representations to the respondents seeking to consider his case for re-engagement as a Conductor on contract basis. The grievance of the petitioner is that though he made several representations, including the latest representations dated 12.07.2017 and 28.12.2018, the respondents are not passing any orders on the said representations nor considering his case for re-engagement as a Conductor on contract basis.

Heard Sri G. Rajesh, learned counsel for the petitioner and Sri N. Vasudeva Reddy, learned Standing Counsel for the respondents - Corporation.

Learned counsel for the petitioner submits that the respondents are not passing any orders on the representations dated 12.07.2017 and 28.12.2018 submitted by the petitioner nor considered the case of the petitioner for re-engagement as a Conductor on contract basis. The learned counsel, therefore, contends that appropriate orders be passed in the writ petition directing the respondents to consider the representations dated 12.07.2017 and 28.12.2018 submitted by the petitioner for consideration of his case for re-engagement as a Conductor on contract basis and pass appropriate orders in accordance with law.

On the other hand, learned Standing Counsel for the respondents - Corporation contends that the case of the petitioner will be considered and appropriate orders would be passed on the representations dated 12.07.2017 and 28.12.2018 submitted by the petitioner in accordance with law. This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representations dated 12.07.2017 and 28.12.2018 seeking to consider his case for re-engagement as a Conductor on contract basis and pass

appropriate orders in accordance with law within a period of six (6) weeks from the date of receipt of a copy of this order. With the above observations, the writ petition is disposed of. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
