HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO M.A.C.M.A. No.1324 of 2005 JUDGMENT:
None appears for the appellant.
This appeal is preferred seeking enhancement of compensation by the claimant. The claim was filed for Rs.2.00 lakh initially and it was subsequently enhanced to Rs.7.00 lakh. The Tribunal passed an award for an amount of Rs.1,88,500/- with subsequent interest at 9% per annum from the date of filing of petition i.e., 28.02.2003 till the date of realization, by its award dated 19.01.2005.
The present appeal was dismissed against the first respondent, owner of the vehicle, and in the absence of the owner of vehicle, the appeal cannot be taken up for consideration as the liability of insurance company is co-extensive with that of the owner of vehicle. Today when the case is called, learned counsel for the appellant is absent. On both these grounds, this Appeal is dismissed. There shall be no order as to costs.
