THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.16499 OF 2016 ORDER:

This Criminal Petition, under Section 482 Cr.P.C., is filed to quash the proceedings against the petitioners in Cr.No.508 of 2016 of Neredmet Police Station, Cyberabad, Rangareddy District, registered against the petitioner for the offence punishable under Section 381 of I.P.C.

During hearing, Sri Vankani Mallesham, learned counsel for the petitioner, requested to direct the police to follow the procedure contemplated under Section 41-A of Cr.P.C. and the guidelines laid down by the Apex Court in ARNESH KUMAR v. STATE OF BIHAR1 before effecting the arrest of the petitioner. Acceding to the request of the counsel for the petitioner, the Police, Neredmet Police Station, are directed to follow the procedure contemplated under Section 41-A of Cr.P.C. and the guidelines laid down by the Apex Court in ARNESH KUMAR v. STATE OF BIHAR referred to supra, before effecting the arrest of the petitioner.

Accordingly, the criminal petition is disposed of without deciding the merits of the case.

Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
