THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.926 OF 2019 ORDER:
The petitioner is A-3 in Crime No.1 of 2019 of Wanaparthy Police Station, Wanaparthy, registered for the offences punishable under Sections 304-II read with 34 of Indian Penal Code against him among other accused about six in number for the attack on one P.Pushpender Yadav, husband of de facto complainant, from a quarrel after midnight of 31.12.2018 on the eve of 1st January.

Heard learned counsel for the petitioner/A-3 and also learned Public Prosecutor representing the respondent State in anticipatory bail application of the petitioner and perused the grounds and the FIR and the remand report from the progress of investigation, dated 03.01.2019, in remanding Accused Nos.1, 2, 4, 5 & 6 while showing the petitioner/A-3 in abscondance.

Sofar as the anticipatory bail concerned, there are no grounds to consider the fact that others granted regular bail after remand is not a ground even when the very remand report shows his participation also, but for consider to only to the extent of directing police not to arrest him till 16.03.2019, as there are examinations and time table filed in the event of showing that he is appearing for the examinations. Remedy if at all is left open to surrender and move for regular bail before the Court concerned.

With the above observations, the Criminal Petition is disposed of. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
