THE HON'BLE SRI JUSTI CE T.SUNI L CHOWDARY CRIMINAL REVISION CASE NO.2624 OF 2016 ORDER:

This revision case is filed by the petitioner under Sections 397 and 401 of the Code of Criminal Procedure challenging the order dated 23.09.2016 in Crl.M.P.No.29 of 2016 in MC.No.136 of 2015 on the file of the XVI Additional District & Sessions Judge-cum-XVI Metropolitan Sessions Judge-cum-III Additional Family Court, Ranga Reddy District at Malkajgiri.

Heard Sri Venugopal, learned Senior Counsel representing Sri A.Sumanth, learned counsel for the petitioner and Sri Suryanarayana Murthy, learned counsel for the respondents 1 and 2. 3.

At the time of arguments, both the learned counsel submitted that a direction may be given to the trial Court to dispose of the main case by fixing some time. Learned counsel for the petitioner submitted that the petitioner is ready and willing to pay maintenance amount regularly but requested time to pay arrears of maintenance in view of the prevailing situation (demonetisation).

Having regard to the facts and circumstances of the case, the trial Court is hereby directed to dispose of MC.No.136 of 2015, as expeditiously as possible, preferably within a period of six (6) months from the date of receipt of a copy of this order. The petitioner is directed to pay the interim maintenance amount as granted by the trial Court regularly. The petitioner is directed to deposit the arrears of maintenance amount on or before 19.01.2017.

The Criminal Revision Case is, accordingly, disposed of.

Miscellaneous petitions, if any pending in this criminal revision case, shall stand closed.
