HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION Nos.3219 and 3229 of 2019 COMMON ORDER :
Since the issue raised in these two writ petitions is one and the same, they are heard together and being disposed of by way of a common order.
The grievance of the petitioners in these two writ petitions is that though they were appointed as Attenders in the 3rd respondent - Potti Sri Ramulu Telugu University and their services were also regularised in the said category, they are not paid the regular Pay Scale attached to the post of Attender and they were not extended the Pay Scales of 2010 and 2015 on par with the other similarly situated employees.
When the matter is taken up for hearing, learned counsel for the petitioners submits that the issue raised in these writ petitions is squarely covered by the order dated 09.06.2017 in W.P.No.13116 of 2011 passed by this Court.
The learned Standing Counsel for the 3rd respondent - University has not disputed about the said fact and contends that similar orders be passed in these writ petitions also. In view of the above submissions made by the learned counsel for the respective parties, this Court is of the considered view that these writ petitions can be allowed setting
AKS, J W.P.Nos.3219 & 3229 of 2019 aside the impugned proceedings Lr.Roc.No.13157/AI/2010, dated 11.03.2011, issued by respondent No.4, and respondent Nos.2 and 3 are directed to approve the Pay Fixation of the petitioners in the Pay Scales of Pay Revision Commission 2010 as per the Notification issued by the Government in G.O.Ms.No.137, Finance (PC-I) Department, dated 28.04.2010. It is made clear that such exercise shall be completed within a period of two (2) months from the date of receipt of a copy of this order.
With the above observations, these writ petitions are allowed. No order as to costs.
As a sequel, miscellaneous petitions pending, if any, in these writ petitions shall stand closed.
