This writ petition is filed declaring the action of the 4th respondent in not receiving and registering sale document presented by the petitioner in respect of the land admeasuring Ac,0-31 cents in Sy.No.314-1 out of Ac.3-54 cents situated at Gorantla Village and Mandal, Anantapur District and insisting the petitioner to obtain 'No Objection Certificate' from the respondents 2 and 3, as illegal and arbitrary.
When the matter is taken up for hearing, it is represented by the learned counsel for the petitioner that the lis in the writ petition is squarely covered by the order dated 24.07.2012 in W.P.No.22485 of 2012 passed by this Court and the same is not disputed by the learned Assistant Government Pleader for Revenue.
For the reasons alike, this writ petition is also disposed of directing the 4th respondent to receive and process the document presented by the petitioner for registration without insisting for submission of "No Objection Certificate" from the revenue authorities and if the same are not included in the list of prohibited properties under Section 22-A of the Registration Act, 1908 or no injunction order prohibiting registration of subject lands is in operation and same is in order as per provisions of Indian Stamp Act, 1899 and the
Registration Act and the Rules made thereunder. Otherwise he shall record the reasons for refusal of the registration and communicate the same to the parties. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 28.04.2017 dv
