THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.16874 OF 2010 ORDER:

The writ petition is filed seeking a writ of mandamus declaring the action of the respondents 1 and 2 in appointing third respondent as a fair price shop dealer of shop No.152, Kurnool Urban, Kurnool District, by proceedings Rc.B.356/2010, dated 21.04.2010, contrary to the guidelines issued in G.O.Ms.No.52, dated 18.12.2008, as illegal and arbitrary, and set aside the same.

Heard and perused the material.

On 20.11.2014, when the case was called, learned counsel for the petitioner was absent and there was no representation, and as such, the writ petition was dismissed for default/non-prosecution. Subsequently, by order, dated 08.12.2016, passed in W.P.M.P.No.50397 of 2016, the writ petition is restored to its file. Again today, i.e., 23.01.2017, when the case is called, learned counsel for the petitioner is absent and there is no representation. Hence, the writ petition is liable to be dismissed for default/ non-prosecution.

The writ petition is accordingly dismissed for default/ non-prosecution. Consequently, miscellaneous petitions, if any shall also stand dismissed.
