THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.96 of 2016 ORDER :

Heard counsel for the petitioner and the Government Pleader for Civil Supplies appearing for respondents.

2. In this Writ Petition, petitioner has questioned the proceedings dt.16.12.2015 of the 2nd respondent suspending the Fair Price Shop Dealership authorization of the petitioner.

3. Counsel for the petitioner contended that the explanation given by the petitioner to the show cause notice dt.24.11.2015 issued by the 2nd respondent has not been considered while passing the impugned order.

4. I am unable to accept the said submission because the said explanation will undoubtedly be considered by the 2nd respondent while passing a final order in the matter, after conducting an enquiry as contemplated in sub-Clause(5) of Clause(5) of the A.P. State Public Distribution System (Control) Order, 2008.

5. Therefore, this Writ Petition is disposed of directing the 2nd respondent to complete the proceedings against the petitioner pursuant to the show cause notice dt.24.11.2015, in accordance with law, on or before 16.03.2016. There shall be no order as to costs.

6. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
