HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 10806 of 2004 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in rejecting the case of the petitioner for appointment to the post of Junior Plant Attendant in the existing vacancy, as illegal and arbitrary. A consequential direction is also sought to the respondents to appoint the petitioner as Junior Plant Attendant in the existing vacancy.

When the matter is taken up for hearing, it is reported by the learned standing counsel for the respondents that the petitioner was selected in the subsequent recruitment and, therefore, the cause in the writ petition does not survive. The same fact is also not disputed by the counsel for the petitioner.

In view of the above, the writ petition is dismissed as infructuous. However, it is always open for the petitioner to approach this Court for pursuing his remedy, if he is still aggrieved by any of the action of the respondents.
