THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.974 OF 2018 ORDER:

This petition is filed by the petitioners-A1 and A2 under Section 482 Cr.P.C. to quash the proceedings in Cr.No.15 of 2018 on the file of Station House Officer, Sanjeevareddy Nagar Police Station, Hyderabad.

Heard learned counsel for the petitioners, learned Assistant Public Prosecutor representing the State and perused the record.

In the course of submissions, it is brought to the notice of this Court that the petitioner-A2 lodged a report against the de facto complainant alleging outraging the modesty and that a case in Cr.No.3 of 2018 was registered for the offences punishable under Sections 354 and 506 IPC and it is under investigation. The counsel for the petitioners would submit that as a counter blast, this case is foisted and also submits that the petitioner-A1 said to be the eye witness to the alleged offence also roped in this case.

Having regard to the submissions made, the police can be directed to proceed with the investigation of the case without effecting arrest of the petitioners.

In the result, the Station House Officer, Sanjeevareddy Nagar Police Station, Hyderabad, shall not arrest the petitioners-A1 and A2 and complete the investigation and file charge sheet or final report as the case may be. 6.

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
