HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION Nos.24323 & 24343 of 2017 COMMON ORDER:

Heard the respective learned counsel for the respective petitioners and learned Government Pleader for Higher Education and also Sri Abhisekh Reddy, learned standing counsel for the 2nd respondent-JNTU in W.P.No.24343 of 2017=1st respondent in W.P.No.24323 of 2017 and perused the prayer in the respective writ petitions with the supporting affidavits and the other material on record.

The prayers in the two writ petitions are confined to a clarification to be issued in relation to operative portion of the earlier common order in W.P.Nos.19946 & 19969 of 2017 dated 23.06.2017. The operation portion of the order reads as follows: "Having regard to the above, these Writ Petitions are disposed of by reiterating the said clause (c) of said procedure prescribed by JNTU. The petitioners are directed, according to the above, to apply afresh for No Objection Certificate within two days from the date of receipt of this order and JNTU shall consider and pass orders within one week therefrom subject to certificate closure progressive."

The procedure to be followed for the change of University affiliation as per the guidelines of JNTU from clause (c) reads as follows:

"The Management has to submit an affidavit for progressive closure of the courses affiliated to JNTUH and to pay the affiliation and common service fee in vogue for the existing

Dr. SSRB,J students if any for the remaining period of their study as onetime payment prescribed by the JNTUH (Format CUA2)." Thus, what is the order passed is very clear of reiterating said clause (c) of the said procedure prescribed by JNTU. There is nothing of any ambiguity for the JNTU much less to confuse by itself in saying the order to be read for closure of the institution rather than closure of the progressive affiliation. Having regard to the above and in the result, these Writ Petitions are disposed of directing the JNTU to give NOC for change of affiliation pursuant to the said Clause (c). Consequently, miscellaneous petitions, if any, shall stand closed. No costs.
