THE HON'BLE SRI JUSTICE G. CHANDRAIAH AND THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 28733 of 2015 ORDER:- (per Hon'ble Sri Justice Challa Kodanda Ram) The writ petition is filed challenging the order dated 27.07.2015 passed by the 3rd respondent refusing to grant stay pending disposal of the appeal before the 2nd respondent.

2. The issue involved is with respect to granting of Input Tax Credit on LPG.

3. It is submitted by the learned counsel for the petitioner that similar matters are pending before the Tribunal for consideration and absolute stay of collection of disputed tax has been granted. Learned counsel also placed on record the order of this Court in RAK Ceramics (India) Private Limited v. The Assistant Commissioner (CT)-VI[1]. This aspect of the matter is not being disputed by the learned Special Standing Counsel for the respondents.

4. In that view of the matter, there shall be stay of collection of disputed tax, pending disposal of the appeal before the 2nd respondent.

5. Writ petition is disposed of, accordingly. No costs. Miscellaneous petitions, if any pending, shall stand closed. ____________________ G.
